Driving Lessons Terms & Conditions

These Terms and Conditions (“Agreement”) set out the rights and obligations between the Driving Instructor David Horgan of Horgis (“Instructor”) and the Pupil (“Student”). By booking and/or attending lessons, the Student agrees to be bound by these terms.

1. Lessons and Bookings

Lessons are subject to availability and must be booked in advance.

The Instructor reserves the right to refuse or terminate lessons if the Student is under the influence of alcohol, drugs, or any condition that may impair safe driving, and no refund of the lesson fee will be made.

The Instructor will determine when the Student is ready to take the driving test.

2. Payments

All lesson fees must be paid in advance of the start of the lesson this needs to be complete 24 hours before the lesson is due to commence.

Fees are subject to change with reasonable notice.

3. Cancellations and Rescheduling

Please advise me as soon as possible if you cannot attend the driving lesson.

Frequent or short notice cancellations might result in a breakdown of our professional relationship to the point that you might need to seek a new instructor.

The Instructor reserves the right to cancel or postpone lessons at short notice due to vehicle breakdown, illness, or unsafe weather/road conditions.

4. Student Responsibilities

The Student must hold a valid provisional driving licence and present it at the first lesson.

The Student must meet the legal eyesight requirements for driving.

The Student must comply with all instructions given by the Instructor during lessons.

The Student must ensure they are medically fit to drive.

5. Vehicle Use and Safety

Lessons will normally take place in the Instructor’s vehicle, which is insured for tuition purposes.

If the Student wishes to use their own vehicle, it must be roadworthy, taxed, MOT-certified (if applicable), and insured for learner driver tuition. Proof of insurance must be provided.

The Instructor reserves the right to withdraw the vehicle from use in a driving test if they believe the Student is not test-ready or the Student’s behaviour poses a safety risk.

6. Driving Test Bookings

The Instructor normally will book the driving test. The Instructor can advise on suitable dates but is not responsible for DVSA cancellations or changes.

The Instructor reserves the right to refuse use of their vehicle for the test if they believe the Student is not adequately prepared.

7. Liability

The Instructor accepts no liability for any injury, loss, or damage arising from the Student’s actions or failure to follow instructions.

The Student is liable for any traffic offences committed while driving.

The Instructor is not responsible for DVSA decisions regarding the driving test.

8. Confidentiality & Data Protection

The personal information provided by the Student will be kept confidential and used solely for the purpose of delivering driving lessons.

The Instructor complies with GDPR and will not share data without consent.

9. General

The Instructor may update these terms with reasonable notice to the Student.
